Sec. 6-36. – Aggravated assault.


A person commits aggravated assault if such person commits assault as defined in §6-35 under any of the following circumstances:

If such person intentionally, knowing or recklessly impedes the normal breathing or circulation of blood of another person by applying pressure to the throat or neck or by obstructing the nose and mouth either manually or through the use of an instrument.

B.

Aggravated Assault is a Class I offense. Any person convicted pursuant to subsection (4) shall be sentenced to a mandatory minimum jail sentence of ten (10) days that shall not be suspended by the court, in addition to any other sentence.
