Strangulation Law
Sec. 14-40.49. – Assault by strangulation.
(a) It is unlawful to assault another person and to cause, or attempt or intend to cause, physical injury by means of strangulation. (b) Unless a person’s conduct is covered under some other provision of law providing greater punishment, assault by strangulation shall be punishable by a fine not to exceed $5,000.00, by a term of imprisonment of not less than one year nor more than three years, and by exclusion for a period of not less than one year nor more than ten years. (c) Definitions. For the purpose of this subsection, the term “strangulation” means intentionally or knowingly impeding normal breathing or circulation of the blood by applying pressure to the throat or neck or by blocking the nose and mouth.
